Terms of Service

1. Services Provided
GoPhotos provides real estate photography and media services as booked and confirmed. Services may include, but are not limited to:
- Real estate photography
- Commercial photography
- AirBnB and vacation rental photography
- Drone photography and videography
- Walkthrough video
- 3D tours
- Floor plans
- Virtual staging
- Twilight shoots and twilight enhancement
- Same-day delivery
- Social media clip
- Custom property website
- Editing and media delivery
Services are provided as booked and confirmed.
2. Payment Terms
Full payment is due within 24 hours of media delivery. Media is delivered within 24 hours of the shoot unless otherwise stated. Late payments may result in withheld licensing rights. The client may not use any images or media until payment has been received in full.
3. Cancellation & Rescheduling
A $100 cancellation fee applies if the client cancels within 12 hours of the scheduled shoot. No cancellation fee applies for weather-related cancellations. If drone footage is affected by weather, GoPhotos will return at no additional charge to capture drone media. If the property is not ready at the time of the shoot, services will be performed as-is. Light cleaning or minor adjustments may be done at the photographer's discretion but are not guaranteed. Property preparation is the client's responsibility.
4. Copyright & Licensing
GoPhotos retains full copyright ownership of all media. The client receives a non-transferable license to use the media for marketing the specific property. This license does not expire upon sale of the property. The original agent may reuse the media for relisting the same property. If a different agent lists the property, a new license must be purchased. Builders may use media for portfolio marketing purposes. Media may not be resold, transferred, or sublicensed to third parties without written permission from GoPhotos.
5. Portfolio & Marketing Use
GoPhotos retains the right to use media for its website portfolio, social media, advertising, and promotional materials. The client may opt out of public portfolio use upon written request to GoPhotos.
6. Revisions
Unlimited minor revisions are included. Minor revisions are defined as: exposure adjustments, color correction, cropping, straightening, and minor object removal. Major edits, re-staging, or reshoots are not included unless separately agreed in writing.
7. Liability Limitation
GoPhotos' maximum liability is limited to the amount paid for the service in question. GoPhotos is not liable for any indirect, incidental, or consequential damages. GoPhotos is not responsible for listing performance, MLS errors, or marketing outcomes.
8. Reshoot / Refund Policy
In the event of equipment failure, file corruption, or error on the part of GoPhotos, GoPhotos may choose to reshoot or issue a refund. The decision is made at GoPhotos' sole discretion. No refunds are provided for subjective dissatisfaction once services have been rendered.
9. Property Conditions & Safety
The client is responsible for ensuring safe and legal access to the property. The client is responsible for pets, occupants, and contractors on-site. GoPhotos is not liable for pre-existing damage to the property. GoPhotos maintains business insurance. Liability remains capped at the amount paid for the service as set forth in Section 7.
10. File Storage
Media is stored for 30 days after delivery. After 30 days, storage is not guaranteed.
11. Independent Contractors
GoPhotos may use independent contractors to perform services. Such contractors are not employees of GoPhotos. Contractors are responsible for their own taxes and insurance. The liability limitation in Section 7 applies equally to services performed by independent contractors.
12. Governing Law
These Terms of Service are governed by the laws of the State of Florida. Any dispute arising from or relating to these terms or the services provided shall be brought exclusively in the appropriate state or federal court located in the applicable Florida county, and the parties consent to the personal jurisdiction of such courts.
